The purpose of these general terms and conditions of sale is, on the one hand, to provide all legal information concerning the terms and conditions under which the company RC TEAM offers for sale the products presented on its site and proposes to contract, and secondly, to define the rights and obligations of the parties which apply, without restriction or reservation, to all sales of products offered on its Internet site ".www.rcteam.com"by the company RC TEAM.
The company RC TEAM reserves the right to modify these terms and conditions of sale at any time. Modifications may be invoked against users of the site from the date they are put online, and may not be applied to transactions concluded previously.
3. Buyer
The present general terms and conditions of sale are applicable to any Buyer fulfilling the conditions defined in the present article.
Site products www.rcteam.com are offered for sale exclusively to Buyers who are consumers in the following geographical area:
Metropolitan France, Corsica, French overseas departments and territories and the member states of the European Union.
Prior to placing an order, the Buyer declares :
- That the purchase of products on www.rcteam.com is not directly related to its professional activity, and that it is limited to strictly non-professional use;
- have full legal capacity to enter into the present terms and conditions of sale.

5. Order
5.1 Product features - Availability
In accordance with article L 111-1 of the French Consumer Code, the Purchaser may, prior to placing an order, consult the following information on the website of www.rcteam.comof the essential characteristics of the product(s) he wishes to order.
The products presented on the site www.rcteam.com are subject to immediate availability in stock. The validation of the order guarantees the immediate availability of the product for delivery under the conditions of article 7.2.
5.2. Choice of products
The Purchaser must familiarize himself/herself with the products and their characteristics marketed by www.rcteam.com under its sole responsibility and according to its needs to make the choice of the product or products which are the subject of its order. In addition, the Purchaser is aware of the hardware, configurations and other equipment he/she uses, and is the sole judge of the compatibility of the products ordered with those he/she uses.
5.3. Formation of contract - Acceptance of general sales conditions
By creating a "customer account", the Buyer must provide all the information required to process the order as it appears on the site.
Among the various categories offered on the www.rcteam.com (electric cars, radios, batteries, etc.), the Buyer selects one or more products he/she intends to order by clicking on the corresponding "ADD TO CART" icon. The selected product is added to the Buyer's basket.
The Purchaser then clicks on "MY BASKET" and must check that the prices, volumes and quantities of the products offered for sale and appearing in the "BASKET" order summary correspond to his/her wish to purchase.
Once this has been done, the Buyer clicks on "ORDER" to finalize his/her order, and validates it by choosing the method of payment.
Any order for a product offered for sale on the website www.rcteam.com implies full acceptance of these terms and conditions of sale of the company RC TEAM of which the Buyer acknowledges having read prior to ordering by validating the corresponding checkbox.
After acceptance of the general terms and conditions of sale, the order is completed as soon as the Buyer has registered his order by clicking on the "ORDER" icon.
The Buyer's order is confirmed by www.rcteam.comIt is recommended that the Buyer keep this information on a paper or electronic document.
6. Prices
6.1. Applicable price
The selling prices of products online on the website of www.rcteam.comThe prices indicated in Euros, inclusive of all taxes, are those in force on the site at the time of registration of the order form by the Purchaser.
In the event of an obvious error in the price mentioned on the site, which clearly does not correspond to the actual price, the company RC TEAM will inform the Buyer of the actual price applicable to the purchase of the product.
Where the corrected price is higher than the price displayed, the Purchaser will have the choice of cancelling or maintaining the order at the corrected price. When the corrected price is lower than the displayed price, RC TEAM will automatically apply the corrected price to the Buyer.
Prices do not include shipping costs (unless otherwise stated), which are invoiced in addition to the price of the products purchased, according to the amount of the order. Shipping costs will be indicated before the Buyer places the order.
Prices include 20% value-added tax (VAT) in force in France.
The sale of products to French overseas departments and territories and non-EEC countries is tax-free (VAT 0%) on the website. www.rcteam.com. VAT and other customs taxes applicable in these countries and departments will be collected by the carrier upon delivery of the goods ordered to the customer.
Product prices are subject to change by www.rcteam.com at any time and will be applicable to any order placed after the modification without the Buyer being able to claim the previous price.
6.2 Payment of the price
The price is payable in full on the day the order is placed by the Buyer. Any incomplete payment not corresponding to the amount of the purchase will result in the cancellation of the order.
Payment of the full amount of the order will be made by www.rcteam.com at the time of payment validation.
All orders are payable in Euros.
To pay for his order, the Buyer has all the means of payment mentioned on the order form: credit card (Carte Bleue, Mastercard, Visa), Paypal, 3 times free of charge via Cetelem.
The Buyer guarantees to www.rcteam.com that he/she has the necessary authorizations to use the method of payment he/she has chosen when registering the order form.
www.rcteam.com reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the Buyer, or in the event of a payment incident.
In the event of suspected fraud, www.rcteam.com reserves the right to request any proof of identity from the Buyer, to carry out any appropriate verification and/or to proceed with payment by bank transfer, making the execution of the order subject to the satisfaction of these conditions.
7. Delivery and acceptance
7.1 General rules
Products will be delivered to the address indicated by the Purchaser at the time of ordering.
The invoice is made available to the Buyer on his customer account.
www.rcteam.com offers its customers home delivery or delivery to a network of relay points.
In the absence of compliance with the procedures set out below, no claim from the Buyer will be accepted.
7.2. Delivery times
The current delivery time is made up of the order dispatch time plus the transport time.
Products whose orders have been validated and confirmed are dispatched within 24 working hours of receipt of payment, with the exception of orders paid for by cash on delivery.
Actual delivery times depend on the mode of transport chosen by the Buyer at the time of ordering.

In the event of non-compliance with the current delivery deadline, the Buyer may, at his option, either request the cancellation of the sale under the conditions provided for in the second and third paragraphs of article L. 114-1 of the French Consumer Code, or maintain his order.
7.3. Acceptance
We recommend that the Buyer refuses any damaged, open or soiled parcel. He may, if he wishes and before signing the delivery note, check the contents in the presence of the deliveryman.
If in doubt, refuse the parcel and report the incident to www.rcteam.com as soon as possible.
Once the package has been accepted and received, no claim can be made against the carrier.
RC Team cannot be held responsible for products damaged or lost in transit.
7.4 Quality or conformity problems
In the event of delivery of a product that does not correspond to the order (damaged or non-conforming), complaints must be addressed as soon as possible to the Customer Service Department of www.rcteam.com by phone or e-mail.
They must include the Purchaser's contact details, the product references, and the reasons for and justification of the complaint. In this context, www.rcteam.com may ask the Buyer to send it the photographs and explanations necessary for rapid processing of complaints.
The return of the product in its original condition and packaging, together with all accessories, guarantees the integrity of the equipment and proof of the cause of the complaint. Failing this, www.rcteam.com reserves the right to make any reservations regarding the claim.
The cost of returning the non-conforming product shall be borne by www.rcteam.comexcept in the case where the returned or exchanged product does not correspond to the original declaration made by the Buyer.
If the above procedure is not followed, the Buyer will not be entitled to make any claim for non-conformity or apparent defect of the products delivered, as the products will then be deemed to be in conformity and free of any apparent defect.
8. Right of withdrawal
The Buyer's right of withdrawal is subject to the following conditions www.rcteam.com within 30 days from the day after receipt of the product.
Products must be returned to www.rcteam.com in perfect condition for resale, in their original state, with no trace of use and accompanied by the invoice or the Purchaser's contact details and the complete references of the order.
Batteries that have already been charged or vehicles that have been used (even for 5 minutes) cannot be returned.
Similarly, if the product includes a warranty sheet or any other document to be completed, this must not be filled in so that the Buyer can exercise his right of withdrawal.
Any product that is incomplete, damaged or whose original packaging has been damaged in such a way as to affect the normal sale of the product will not be reimbursed.
All risks associated with the return of the product shall be borne by the Buyer.
Exercise of the right of withdrawal will give rise to reimbursement by the means used by the Buyer to pay for the order, with the exception of payments made by bank transfer, which will be reimbursed by bank transfer once the Buyer has communicated to www.rcteam.com bank details (IBAN and BIC).
9. Guarantee
Products supplied by RC Team benefit, in accordance with legal provisions :
- the legal guarantee of conformity,
- the legal warranty against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use,
- the manufacturer's warranty, depending on the products and brands concerned.
All warranties are excluded in the event of misuse, negligence or lack of maintenance on the part of the Buyer, as well as in the event of normal wear and tear, accident or force majeure, and the Seller's warranty is limited to the replacement or reimbursement of non-conforming or defective products.
The general conditions and duration of the warranty are available on the website of www.rcteam.com heading "SAV Retour". The Buyer will be deemed to have consulted and accepted them.
In the event that the instructions are not delivered with the product, and upon simple request by the consumer, www.rcteam.com will send you the French version of the leaflet or a link to access it.
The product under warranty will be exchanged or repaired, at the manufacturer's discretion.
www.rcteam.com guarantees the Purchaser against hidden defects and faults. This warranty applies on condition that the defect is hidden, renders the product unfit for its intended use or significantly diminishes its use; and exists at the date of purchase, such that the Purchaser would not have purchased it had he known of it.
In any event, warranties do not cover :
- replacement of consumables,
- abnormal or improper use of products,
- damage specifically mentioned in the product data sheets,
- defects and their consequences due to the intervention of the Buyer or a third party,
- defects and their consequences due to use which does not conform to the intended use of the product (professional, collective use, etc.).
10. Warranty for professionals
Any purchase intended for professional use, such as resale or rental, will not benefit from the after-sales guarantee offered by RC TEAM. By accepting these general terms and conditions of sale, you acknowledge and agree that the after-sales warranty is not applicable to products purchased for commercial or rental purposes. This warranty exclusion also applies to products used for professional purposes, even if purchased for personal use.
RC TEAM declines all responsibility for repairs, replacements or any other after-sales service for purchases intended for professional use. We therefore encourage you to take this clause into account before making a purchase for commercial or rental purposes.
11. Liability
The products offered by www.rcteam.com comply with current French legislation.
The website www.rcteam.com cannot be held responsible for non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications, or the customer's fault.
The website www.rcteam.com shall not be held liable for any consequential damages arising from the purchase of products.
The total or partial impossibility to use the products, notably due to hardware incompatibility, cannot engage the responsibility of www.rcteam.com nor give rise to any compensation or reimbursement.
The website www.rcteam.com also contains information from third parties and links to other websites. www.rcteam.com shall in no event be liable for any damages whatsoever resulting from the use of, access to, or inability to use, such third-party information or the content of other websites.
11. Intellectual property rights

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
12. Partial invalidity
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations shall retain their full force and scope.
13. No waiver
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be construed as a waiver of the obligation in question for the future.
14. Applicable law
Sales of products by the company www.rcteam.com are governed by French law.
15. Data protection
Pursuant to the French Data Protection Act 78-17 of January 6, 1978, we remind you that the nominative data requested from the Buyer is necessary for the processing of his/her order and, in particular, for the preparation of invoices.
In accordance with current national and European regulations, the Buyer has a permanent right of access, modification, rectification and opposition with regard to information concerning him/her.
The information collected by www.rcteam.com during any order by the Buyer are necessary for the management of his order by www.rcteam.com which may pass on all or part of the information to its commercial partners after obtaining the customer's consent and ensuring that it is used for the intended purpose, and that it is destroyed as soon as the commercial relationship has ended.
As part of the fight against Internet fraud, order and payment information may be transmitted to persons authorized by law for verification.
Upon confirmation of the Buyer's order, its value is transmitted to the Google Analytics© service for statistical use, without the Buyer's personal data being transmitted.
